After being programmed for complete compatibility, modules are then tested in their intended switch/platform. Virtually every manufacturer is represented in U.S. Critical's production test bed in California.

 

Due to our long-standing Telecom relationships, U.S. Critical uses Aeroflex/Shenick for our network emulation testing platform. Aeroflex/Shenick is a fully virtualized test and measurement solution that can emulate and measure millions of unique application flows. The test provides comprehensive measurement and performance analysis on each application flow, easily and accurately locating and isolating problematic flows. Performance analysis of the optic in both real world or customer specific application flows are the only true way to guarantee design integrity and complete optical compliance.

 

* In today's third party market, testing is quite often the most confusing aspect when selecting a third party vendor. Everyone says they have a 100% tested third party optic. But truth be told, very few, if any online vendors actually test their product. They simply don't have the resources to do it. Magnuson-Moss Warranty Act & the Sherman Antitrust Act

On occasion, U.S. Critical hears reports that a computer system manufacturer's sales representative has told a customer (which could be an end user, reseller or integrator) that if the customer uses third party optics, cables or memory in the manufacturer's system, the system manufacturer's warranty is voided. Through this ploy, the sales representative attempts to coerce customers into purchasing products from the system manufacturer, usually at prices much higher than U.S. Critical. A system manufacturer may resort to this type of warranty threat to spread fear, uncertainty and doubt in the minds of consumers (hence its industry nickname: FUD marketing), rather than to compete on the basis of quality and price.

 

In legal terms, this type of ploy is referred to as a "tie-in sales provision." In general, such provisions are illegal. They are specifically prohibited in the consumer market by section 102(c) of the Magnuson-Moss Warranty Act of 1975 (15 United States Code section 2302(c)). In the networking and server markets, such ploys violate sections 1 and 2 of the Sherman Antitrust Act (15 United States Code sections 1 and 2). As the United States Supreme Court has stated:

"The essential characteristic of an invalid tying arrangement lies in the seller's exploitation of its control over the tying product [here, the networking/computer system] to force the buyer into the purchase of a tied product [here, the optic sold by the system manufacturer] that the buyer either did not want at all, or might have preferred to purchase elsewhere on different terms. When such "forcing" is present, competition on the merits in the market for the [optic module] is restrained and the Sherman Act is violated." Jefferson Parish Hospital District No. 2 v. Hyde, 466 U.S. 2 (1984).

 

Companies and individuals that violate the antitrust laws are subject to a wide range of sanctions, including having triple damages imposed against them. The important point is that, regardless of their legality, these types of sales ploys are intended to intimidate and pressure unsophisticated purchasers into spending substantially more than they should for memory upgrades.

 

U.S. Critical strongly supports customer choice and believes that consumers - whether end user, reseller, or systems integrator - should be free to purchase compatible products without being subject to threats and misinformation. Throughout its existence, U.S. Critical has made reliability our first priority.

Warranty and Replacement Process

All products have been thoroughly tested to be free of defects in material and workmanship. If any product should malfunction while used in its recommended environment during the applicable warranty period, U.S. Critical, at its option, will repair or replace the product at no charge, provided the product or any part thereof has not been abused, misused, neglected, replaced, repaired, or modified. U.S. Critical shall make the final determination as to the existence and cause of any defect. No warranty is made with respect to custom products produced to original Buyer specifications, except as specifically stated in writing by U.S. Critical. Buyer acknowledges and agrees that neither U.S. Critical nor any agent or representative of U.S. Critical has made any warranty, promise or guarantee regarding the product or its suitability for any particular use except as expressly set forth herein. U.S. Critical warranty shall not be enlarged, diminished, or affected by, and no obligation or liability shall arise or grow out of, U.S. Critical rendering of technical advice or service in connection with any product furnished there under. U.S. Critical makes no representation or warranty whatsoever to Buyer with respect to the performance, appropriate use, safety or characteristics of the products, except as expressly provided herein. U.S. Critical reserves the right to make modifications to both hardware and software without prior notification.

THE FOREGOING EXPRESS WRITTEN WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ANY OTHER WARRANTIES OR REMEDIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. In the unlikely event of a defect or failed item, immediately make note of the part number, serial number, and issue. Email or call to submit part(s) and receive an RMA # via email. We will promptly send the RMA number and a prepaid label for shipping the defective product back to U.S. Critical Optics. Please let us know if there is a production link at stake, for we will often cross-ship to ensure minimal downtime. For customers who do not practice sparing, replacement product is usually in stock and ready to ship (EOL product can take a few days to complete RMA process).

Warranty Duration by Product Line:

Transceivers - Limited Lifetime Warranty:

  • U.S. Critical transceivers designed to reach less than 80 kilometers carry a serviceable Lifetime Warranty of 10 years from the date of purchase from U.S. Critical or an authorized U.S. Critical distributor.
  • Transceivers that are designed to reach 80 kilometers or further, or custom made U.S. Critical parts, the serviceable lifetime warranty is 5 years.
  • Transceivers purchased that are not branded or programmed by U.S. Critical will have a warranty provided by the original manufacturer. These products may only be returned in accordance with the return policy in effect for the original manufacturer. The warranties and technical support may vary from product to product.

Direct Attach Cabling - Limited Lifetime Warranty:

  • U.S. Critical Direct Attach Cables carry a serviceable Limited Lifetime Warranty of 10 years from the date of purchase from U.S. Critical or an authorized U.S. Critical distributor.

Cables - Limited lifetime Warranty:

  • U.S. Critical warrants to the original purchaser that its jumper, breakout and trunk cabling will be materially free from defects under normal use and service for as long as the original user owns the product, or for five years after discontinuation of such product, whichever is sooner.

Cable Management - Limited Lifetime Warranty:

  • U.S. Critical warrants to the original purchaser that its Cable Management Systems will be materially free from defects under normal use and service for as long as the original user owns the product, or for five years after discontinuation of such product, whichever is sooner.

Media Converters - 5 Year Warranty:

  • U.S. Critical Media Converters carry a serviceable Lifetime Warranty of 5 years from the date of purchase from U.S. Critical or an authorized U.S. Critical distributor.

Warranty Duration by Product Line:

You may return most new, unopened items within 15 days of delivery for a full refund. You should expect to receive your refund within four weeks of giving your package to the return shipper; however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

 

*The mis-order of proper part number due to configuration by the client are eligible for credit only if the returned products and packaging are clean, unused, and in a fully resalable condition. A restocking charge of 25% of the sale price may be charged. Under no circumstances will credit be issued after 15 days from date of invoice. All freight charges are the responsibility of the customer.

Domestic Shipments

Most of our shipments across the full transceiver family and all network platforms can ship overnight. We respect our customers' strategic implementation timelines, and have saved them millions with our fast delivery (vs having them wait for an OEM to deliver). We can often ship overnight with a 4pm PST order submission. Larger shipments can take a day to ship, and orders of 1000+ pieces can usually ship within 2-3 business days.

international Shipments

We drop ship worldwide to virtually any address serviced by UPS™, DHL™, or FedEx™. Even with international shipping fees and tariffs, our abroad customers have us drop ship to their data center buildouts for maximum savings while ensuring quality. Customers from Europe, Asia, Africa/Middle East, and Latin America receive their products by air transport within 2-3 days of order.

Import duties and shipping are paid for by the customer. After VAT, import and shipping costs are added, the customer still typically saves hundreds, if not thousands, of dollars.

Our primary shipping carrier is FedEx, and their price is calculated automatically via the checkout function on our website. Many of our international customers, however, have us use their DHL or UPS number. In this case, the customer simply fills out and faxes Credit Card Authorization (including shipper number and carrier), and we will quickly process the order.
